Overview

Welcome to WildScales. The terms “we”, “us” and “our” refer to WildScales. WildScales operates this store and website, including its information, content, features, tools, products and services (the Services).

These terms and conditions, together with the policies linked from this website (the Terms), describe your rights and responsibilities when using the Services. By visiting, interacting with or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Access and Accounts

You represent that you are at least the age of majority in your state or territory, or have the consent of a parent or guardian. Information you provide, including email, billing, payment and shipping information, must be accurate, current and complete.

You are responsible for protecting access to your email account and for activity performed through sign-in links sent to that address. You may not sell, transfer or license your WildScales account.

2. Our Products

We make reasonable efforts to describe and display products accurately. Colours and appearance may vary because of device and display settings. Product descriptions may change without notice, and we may discontinue products or limit quantities or availability by person, region or jurisdiction.

3. Orders

Placing an order is an offer to purchase. We may accept or decline an order, including because of stock, pricing or suspected fraud. An order is accepted when we confirm acceptance after payment is received and processed. Review your order carefully before submitting because cancellation may not be possible after acceptance.

If we decline, change or cancel an order, we will attempt to contact you using the details supplied with the order. Returns and remedies are governed by our Refund Policy and your rights under Australian Consumer Law.

4. Prices and Billing

Prices are in Australian dollars unless stated otherwise and may change without notice. The price charged is the price shown when the order is submitted, subject to correction of genuine errors. Shipping and any applicable taxes or fees are shown before payment.

You must be authorised to use the payment method submitted. Payments are processed by our payment provider; WildScales does not store full payment-card details.

5. Shipping and Delivery

Delivery timeframes are estimates and may be affected by carriers, weather, peak periods and events outside our reasonable control. Shipping, tracking, insurance and delivery responsibilities are described in our Shipping Policy.

6. Intellectual Property

The Services—including WildScales names, logos, text, photographs, graphics, video, audio, software and design—are owned by WildScales or its licensors and protected by applicable intellectual-property laws.

You may use the Services for personal, non-commercial purposes. You must not reproduce, distribute, modify, republish, scrape, store or transmit material from the Services without permission, except where law permits. Third-party names and marks remain the property of their owners.

7. Third-Party Tools and Links

The Services may provide access to tools, functionality or websites operated by third parties. Those services may have their own terms and privacy policies. We are not responsible for evaluating their content, accuracy or practices. Your use of a third-party service is at your own risk.

8. Privacy

Our collection, use and disclosure of personal information is governed by our Privacy Policy. Service providers may process information on our behalf as described in that policy.

9. Feedback

If you send us ideas, suggestions, reviews or other feedback, you grant WildScales a worldwide, royalty-free licence to use, reproduce, modify, publish and display it for operating, improving and promoting the Services. You must own or have permission to provide your feedback and must disclose any relevant incentive.

10. Errors and Omissions

Information may occasionally contain errors relating to descriptions, pricing, promotions, shipping, transit times or availability. We may correct errors, update information or cancel affected orders. If a paid order is cancelled, we will provide an appropriate refund.

11. Prohibited Uses

You must not use the Services to break the law; infringe rights; harass or harm others; transmit false, malicious or misleading information; distribute spam or malware; impersonate another person; collect others' personal information; interfere with security or availability; or attempt unauthorised access.

Automated systems must identify themselves honestly, comply with published robot controls and rate limits, and must not bypass CAPTCHAs, authentication, authorisation or other safeguards. We may limit or block abusive automated access.

12. Termination

We may suspend or terminate access where we reasonably believe these Terms have been breached or the Services, WildScales or another person may be harmed. Obligations which by their nature should survive termination will continue.

13. Disclaimer

Information made available through the Services is general information. To the extent permitted by law, the Services are provided “as is” and “as available”. Nothing in these Terms excludes guarantees, warranties or remedies that cannot lawfully be excluded, including rights under Australian Consumer Law.

14. Limitation of Liability

To the fullest extent permitted by law, WildScales and its officers, employees, contractors and service providers are not liable for indirect, incidental, special or consequential loss arising from use of the Services. This limitation does not apply where liability cannot lawfully be excluded or limited.

15. Indemnity

To the extent permitted by law, you agree to indemnify WildScales against third-party claims arising from your material breach of these Terms, violation of law or infringement of another person's rights.

16. Severability and Waiver

If any provision is unlawful or unenforceable, it will be limited or severed to the minimum extent necessary without affecting the remaining provisions. A failure to enforce a right is not a waiver of that right.

17. Entire Agreement and Assignment

These Terms and policies posted on the website are the agreement between you and WildScales concerning the Services. You may not assign your rights or obligations without our consent. We may assign ours in connection with a legitimate transfer of the business or Services.

18. Governing Law

These Terms are governed by the laws of Queensland, Australia. You and WildScales submit to the courts of Queensland and the courts entitled to hear appeals from them, subject to any rights you have under applicable consumer law.

19. Changes to These Terms

We may update these Terms by publishing a revised version on this page. Material changes take effect on the date stated in the notice or as otherwise permitted by law. Continued use after changes take effect constitutes acceptance of the revised Terms.
